1. Acceptance of Terms

By accessing or using Believers Dating (the "Service"), operated by ShommyX Technologies Inc. ("ShommyX," "we," "us," or "our"), you agree to be legally bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use the Service.

These Terms apply to all users of the platform, including those who access the Service through believersdating.com or through integrations with ShommyX Church.

By creating an account, you represent and warrant that you have the legal capacity to enter into a binding agreement.

2. Eligibility

To use the Service, you must:

• Be at least eighteen (18) years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Not have been previously suspended or removed from the Service for violations of these Terms

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to request proof of age or identity at any time and to suspend or terminate accounts that do not meet these requirements.

3. Account Registration and Security

You are responsible for all activity that occurs under your account. You agree to:

• Provide accurate, current, and truthful information at all times
• Maintain the confidentiality of your login credentials
• Immediately notify us of any unauthorized use or security breach
• Ensure that your account is used only by you and not shared with others

You are solely responsible for any actions taken using your account, whether authorized or unauthorized. We reserve the right to suspend or terminate accounts that contain false, misleading, or incomplete information.

4. User Conduct and Acceptable Use

You agree to use the Service in a lawful, respectful, and responsible manner. You must not:

• Harass, abuse, threaten, exploit, or harm other users
• Engage in hate speech, discrimination, or offensive behavior
• Post false, misleading, deceptive, or fraudulent information
• Impersonate any person or entity
• Use the Service for commercial solicitation, advertising, or scams
• Attempt to gain unauthorized access to accounts, systems, or data
• Use bots, scripts, or automated systems to access or interact with the Service
• Upload or distribute malware, viruses, or harmful code
• Circumvent or attempt to bypass any safety or security features

We reserve the right to investigate and take appropriate action, including content removal, account suspension, or permanent bans.

5. User Content and License

You retain ownership of any content you submit, post, or display on the Service, including profile information, photos, messages, and other materials ("User Content").

By submitting User Content, you grant ShommyX a non-exclusive, worldwide, royalty-free, sublicensable license to:

• Host, store, reproduce, and display your content
• Distribute and make your content available to other users as part of the Service
• Use your content for the operation, improvement, and promotion of the platform

You represent and warrant that:

• You own or have the necessary rights to your content
• Your content does not violate any laws or third-party rights
• Your content is accurate and not misleading

We reserve the right (but not the obligation) to review, remove, or restrict any content that violates these Terms or poses a risk to users or the platform.

6. Privacy and Data Use

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection, use, and processing of your information as described in the Privacy Policy. You acknowledge that certain information you provide, including profile details and preferences, may be visible to other users of the Service based on your privacy and visibility settings.

7. Profile Visibility and Verification System

The Service operates a tiered user system designed to promote trust and safety. Users are categorized as:

• Verified Church Members: users affiliated through ShommyX Church
• Non-Verified Users: users registered directly through believersdating.com

By default:

• Verified Church Members may only view and interact with other Verified Church Members
• Non-Verified Users may only view and interact with other Non-Verified Users

Verified Church Members may choose to enable a setting that allows their profile to be visible to Non-Verified Users. By enabling this setting, you acknowledge and agree that:

• Your profile may be visible to users who are not affiliated with any verified church
• Such users may not have undergone the same level of identity or community verification
• You assume all risks associated with interactions resulting from this visibility setting

ShommyX does not guarantee the identity, intent, or conduct of any user, regardless of verification status.

8. User Interactions and Safety Disclaimer

Believers Dating is a platform that facilitates introductions and communication between users. You understand and agree that:

• ShommyX does not conduct criminal background checks on users
• ShommyX does not verify all user identities or profile information
• ShommyX does not control or monitor user behavior outside the platform

You are solely responsible for:

• Your interactions with other users
• Any communications, meetings, or relationships formed through the Service

You agree to take appropriate precautions when interacting with others, including meeting in public places and protecting your personal information.

To the maximum extent permitted by law, ShommyX shall not be liable for:

• Any actions, omissions, or conduct of other users
• Any harm, loss, or damages resulting from interactions between users
• Any offline interactions, meetings, or relationships

Use of the Service is at your own risk.

9. Moderation, Enforcement, and Account Actions

We reserve the right, but are not obligated, to:

• Monitor activity on the platform
• Investigate suspected violations of these Terms
• Remove content that violates our policies
• Suspend, restrict, or permanently terminate accounts

We may take action without prior notice if we determine that:

• A user poses a risk to others
• A violation of these Terms has occurred
• The integrity or safety of the platform is at risk

Decisions regarding moderation and enforcement are made at our sole discretion.

10. Service Availability and Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Matches or connections will result from use of the Service
• The platform will meet your expectations or requirements

We may modify, suspend, or discontinue any part of the Service at any time without liability.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

11. Payments, Subscriptions, and Chargebacks

Certain features of the Service may require payment. By subscribing to a paid plan, you agree that:

• All fees are charged based on the selected billing cycle (monthly or annually)
• Payments are processed through third-party providers (such as Stripe or Paystack), and you agree to their respective terms
• Fees are non-refundable except where required by law or explicitly stated

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

You agree not to initiate chargebacks or payment disputes without first contacting our support team. We reserve the right to:

• Suspend or terminate accounts associated with fraudulent or abusive payment activity
• Recover outstanding balances through lawful means

Unauthorized chargebacks may result in permanent account suspension.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOMMYX TECHNOLOGIES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, LOSS OF BUSINESS OPPORTUNITIES, OR PERSONAL INJURY ARISING FROM USER INTERACTIONS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100), IF NO PAYMENT HAS BEEN MADE.

13. Indemnification

You agree to indemnify, defend, and hold harmless ShommyX Technologies Inc., its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your interactions with other users
• Your violation of these Terms
• Your violation of any applicable laws or third-party rights

This obligation survives termination of your account and use of the Service.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in Calgary, Alberta, Canada. You agree to submit to the personal jurisdiction of such courts.

15. Force Majeure

ShommyX shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to:

• Internet or infrastructure failures
• Cloud service outages
• Cybersecurity incidents or attacks
• Natural disasters
• Government actions or regulations
• Power or network disruptions

During such events, the Service may be unavailable or degraded without liability.
